Warranty Policy for [Your Online Shop Name]
This Warranty Policy outlines the rights and obligations of customers purchasing from [Your Online Shop Name], an online retailer based in Limassol, Cyprus, with registration number [Your Company Registration Number] and VAT number [Your VAT Number]. This policy applies to both local (Cyprus) and European customers and complies with Cyprus consumer protection laws and EU Directive 2019/771 on certain aspects concerning contracts for the sale of goods. By making a purchase, you agree to the terms outlined below.
1. Legal Guarantee
Under EU and Cyprus law, all products purchased from our online shop come with a minimum 2-year legal guarantee from the date of delivery, free of charge. This applies to new goods, including digital goods and services purchased on or after January 1, 2022. For second-hand goods, a minimum 1-year legal guarantee applies.
What is Covered
The legal guarantee covers products that:
Do not conform to the description, type, quantity, or quality specified in the contract.
Are not fit for the purpose for which they were purchased, including any specific purpose you communicated to us before purchase.
Do not show the quality and performance normal for goods of the same type.
Were not installed correctly due to inadequate instructions provided by us or if installed by us.
Your Rights Under the Legal Guarantee
If a product is found to be non-compliant within the 2-year period (or 1-year for second-hand goods), you are entitled to the following remedies, free of charge (including postage, labor, and materials):
Repair: We will repair the product within a reasonable time, not exceeding 25 days from the date you notify us of the issue, unless you agree to an extension.
Replacement: If repair is not feasible or too costly, we will replace the product with an identical or equivalent item.
Price Reduction or Refund: If repair or replacement is not possible, causes significant inconvenience, or is not completed within a reasonable time, you may request a partial refund (if you keep the product) or a full refund with the return of the product. In some cases, minor defects may not entitle you to cancel the contract.
Notification of Defects
Within 6 Months of Delivery: If a defect appears within 6 months, it is presumed to have existed at the time of delivery, and we are responsible for addressing it.
After 6 Months: You must provide evidence that the defect was present at the time of delivery (e.g., due to poor quality of materials).
In Cyprus, you must notify us of any defect within 2 months of discovering it to benefit from the legal guarantee.
Extension of Warranty Period
The warranty period is extended by the time taken for repairs or negotiations regarding the resolution of a defect. You will receive a written report detailing the technical condition of the product if requested.
Exclusions
The legal guarantee does not apply to:
Goods sold at public auctions or by judicial authority.
Defects caused by misuse, improper installation by the customer (if not due to inadequate instructions), or normal wear and tear.
Defects you were informed of prior to purchase.
2. Commercial Warranty
In addition to the legal guarantee, we may offer a commercial warranty for certain products, which may be included in the purchase price or available at an additional cost. This warranty provides extra protection but does not replace or limit your rights under the legal guarantee. The terms of any commercial warranty will be clearly stated in the product listing or warranty certificate, including:
Duration of the warranty.
Specific conditions and coverage (e.g., accidental damage).
Instructions for claiming under the warranty.
If the commercial warranty terms are less advantageous than those advertised, the more favorable terms apply. You will receive the commercial warranty certificate in a durable format (e.g., hard copy or email).
3. Cooling-Off Period for Online Purchases
As an online shop, we comply with EU and Cyprus regulations for distance contracts. You have the right to withdraw from your purchase within 14 calendar days from the date of delivery (for goods) or the date the contract was agreed (for services), without providing a reason. This is known as the cooling-off period.
How to Exercise Your Right of Withdrawal
Notify us in writing (e.g., via email to [Your Customer Service Email] or through our online return form) within 14 days.
Return the product in its original condition, with all accessories and packaging, within 14 days of notifying us.
You bear the cost of return shipping unless the product is faulty or not as described.
Refunds
We will refund the full purchase price, including original delivery costs, within 14 days of receiving the returned product or proof of return.
Refunds will be processed using the original payment method unless otherwise agreed.
For services, a deduction may apply if the service has been partially used.
Exclusions from the Cooling-Off Period
The right of withdrawal does not apply to:
Personalized or custom-made products.
Perishable goods, sealed audio/video recordings, or software unsealed after delivery.
Services fully performed with your prior consent before the cooling-off period ends.
